Высший орган судебной власти США, предусмотренный разделом 1 статьи III Конституции США [ Constitution, U.S.]. Является высшей судебной инстанцией для дел федеральной юрисдикции и для большинства дел, находящихся в юрисдикции штатов. Первоначально этот единственный судебный орган, о котором непосредственно говорится в Конституции, создавался для рассмотрения дел, касающихся послов, посланников и консулов, а также таких дел, стороной в которых является штат. Ныне Верховный суд является апелляционной инстанцией, а также занимается официальным толкованием законов и конституционных положений. Суд также принимает к рассмотрению дела по собственному усмотрению. Создан в феврале 1790. Состоит из председателя Верховного суда [ Chief Justice of the United States] и нескольких судей [ Associate Justice of the Supreme Court], число которых определяется Конгрессом. Первоначально в 1789 в составе суда было восемь членов, в 1863-66 десять, с 1869 - девять. Ныне в соответствии с законом 1948 членами Верховного суда являются восемь судей. Кандидатуры судей выдвигаются президентом США и утверждаются Сенатом [ Senate, U.S.]. Должность судей Верховного суда пожизненная, однако они могут подавать в отставку по достижении 70-летнего возраста. Заседания Суда начинаются в первый понедельник октября и завершаются обычно в конце июня или после того, как будет исчерпан список представленных на его рассмотрение дел. Назначается Президентом [ President, U.S.] с согласия Сената [ Senate, U.S.] пожизненно в соответствии со статьей III, разделом 1 [Article III, Section 1] Конституции [ Constitution, U.S.]. Роль председательствующего на заседаниях суда - одна из важнейших. Верховный судья ставит дело на обсуждение, контролирует ход дискуссии, предписывает подготовку решения. Вначале он представляет свое суждение о деле, затем спрашивает мнение других членов суда по старшинству, после чего происходит голосование. Если большинство поддерживает верховного судью, он формально назначает ответственного за составление решения; если он в меньшинстве, то задание дает старший судья из большинства.
